A teacher convicted of having a s£xual relationship with a student will not face prison time, but will serve out her sentence on probation.
In November 2024, 26-year-old Shawnee Nicole Despain pleaded guilty to a charge of an improper relationship between educator and student after it was revealed she had a s£xual relationship with one of her pupils.
Despain was a teacher at Rockdale High School in Texas, where the 17-year-old pupil attended agricultural science classes.
An investigation revealed an inappropriate relationship, which led Despain to resign from her role in September 2023. Despain's pregnancy was discovered after DNA testing revealed that her husband was not the father.
Initially, she kept the paternity of the child from her husband until everything became a mess.
Evidence of grooming was discovered on the criminal's phone, with texts that expressed love, and footage of the pair having s£x on Despain's Snapchat.
On November 7, 2023, Despain surrendered and was charged with child pornography and engaging in an improper relationship.
It is commonly believed that teacher-student relationships are a second-degree crime and can lead to up to 20 years in prison.
During a hearing last week, Despain was sentenced by District Judge John W. Youngblood to a 10-year probation instead of jail time. Due to the offence she pleaded guilty to, the former teacher gave up her teaching license, which doesn't need her to be registered as a serious offender.
Brian Price, the Milam County District Attorney, argued that the defendant was deserving of prison time during the hearing. According to Price, the outcome could have been different had the case involved a male teacher and female student.
Price commented: "My argument to the judge was she was in a position of power and trust over her students and she used that to abuse this young man, and that is going to affect him his entire life.
"People put in a position of authority and trust should be held to a higher standard, not a lower one."
